Art. 1 General provisions

1. The user browsing in this section access at LesFolies Luxury, accessible following the url: https://www.lesfolies.luxury (from now on refered as "Lesfolies"). The browsing and the trasmission of a commercial order on the website involve the acceptance of the Terms and Data Protection Policies adopted on this website.

2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (D.lgs. n. 206/05 rectified by D.lgs. n. 21/14 e D.lgs. 70/03) by

3. The user is required, before accessing the products provided by the site, to read these Terms and Conditions of Sale, which are generally and unequivocally understood to be accepted at the time of purchase.

4. The user is encouraged to download and print a copy of the purchase form and of the Terms and Conditions, the terms of which LesFolies reserves the right to change unilaterally and without notice. The Terms and Conditions found in this page and all the articles on the website have been translated from Italian, we cannot be held responsible for any mistakes. Art.2 - Object

1. These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on LesFolies and do not, however, govern the provision of services or the sale of products by parties other than the seller who are present on the same site through links, banners or other hypertext links.

2. Before completing orders and purchasing goods and services offered by different parties, we suggest to read their Terms and Conditions.

Art. 3 - Conclusion of the contract

1. In order to conclude the contract of purchase, it's necessary to fill the form in electronic format and submit it following the relevant instructions.

2. It contains a reference to the General Terms and Conditions of Sale, images of each product and its price, the means of payment that can be used, the mode of delivery of the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of cancellationl; how and time frame to return the purchased products.

3. Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale including the Right of cancellation and Personal Data Treatment Notice.

4. The contract is concluded when the seller receives the form filled out by the user, after checking that the data contained therein is correct.

5. The user will be obligated to pay the price from the moment that the online order submission process is completed. This will be done by clicking on the "Proceed to Purchase" button at the end of the guided procedure.

6. Once the contract is concluded, the seller takes over the order for fulfillment.

Art. 4 - Registered users

1. During the registration procedure the user shall follow the indications on the website and must provide all personal data in a fair and truthful manner.

2. Confirmation will in any case exempt LesFolies from any liability regarding the data provided by the user. The user undertakes to promptly inform LesFolies of any change in their data at all times communicated.

3. If the user communicates inaccurate or incomplete data or even in the event that there is a dispute by the parties concerned about the payments made, LesFolies will have the right not to activate or to suspend the service until the relevant shortcomings are remedied.

4. At the time of the first request for activation of a profile by the user, LesFolies will assign to the same user name and a password. The latter acknowledges that these identifiers constitute the system of validation of the user's accesses to the Services and the only system suitable for identifying the user that the acts performed by means of such access will be attributed to him/her and will be binding on him/her.

5. The user agrees to maintain the secrecy of his or her access data and to guard it with due care and diligence and not to transfer it, even temporarily, to third parties.

Art. 5 - Availability of the products

1. Product availability refers to actual availability at the time during which the user places the order. However, this availability should be considered purely indicative because, as a result of the simultaneous presence on the site of several users, the products could be sold to other customers before the confirmation of the order.

2. Even after the order confirmation e-mail is sent, cases of partial or total unavailability of goods may occur. In this eventuality, the order will be rectified automatically with the deletion of the unavailable product and the user will be immediately informed by e-mail.

3. If the user requests the cancellation of the order, terminating the contract, LesFolies will refund the amount paid within 30 days after LesFolies became aware of the buyer's decision to terminate the contract.

Art. 6 - Offered products

Art. 7 - Method of payments and prices

1. The price of the products will be as stated from time to time on the site, except where there is an obvious error.

2. In the event of an error LesFolies will notify the purchaser as soon as possible allowing the confirmation of the order at the correct amount or cancellation. In any event, there will be no obligation on LesFolies to supply what is sold at the lower price erroneously indicated.

3. Site prices include VAT and do not include shipping costs. Prices are subject to change at any time. Changes do not affect orders for which order confirmation has already been sent.

4. Once the desired products have been selected, they will be added to the shopping cart. You will simply follow the purchase instructions, entering or verifying the required information at each step of the process. Order details may be changed before payment.

5. Payment can be made by:

Credit cards from major circuits, cash with in-store pickup, in installments with Soisy.

Art. 8 - Delivery

1. LesFolies delivers throughout Italy, excluding the Vatican City State and the Republic of San Marino.

2. LesFolies will make its deliveries either to the home provided by the user or to the collection points indicated at the time of purchase.

3. Delivery is generally made within 2-7 days, or, if no delivery date is specified, within the estimated time limit when selecting the delivery method and, in any case, within a maximum of thirty days from the date of confirmation.

4. If delivery is not possible, the order will be sent to the warehouse. In that event, a notice will specify the location of the order and how to agree on a new delivery.

5. If you are unable to be present at the delivery location at the agreed time, please contact us again to arrange a new delivery date.

6. If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we shall assume that we are terminating the contract.

7. As a consequence of termination, the amounts shall be returned, including the costs of delivery with the exclusion of any additional costs resulting from the choice of a delivery method other than the ordinary method offered without undue delay and, in any event, within 30 days from the date of termination of the contract. Transport resulting from the termination of the contract may have additional costs that shall be borne by the purchaser.

8. Shipping costs are responsibility of the purchaser and are explicitly highlighted when placing the order.

Art. 9 - Right of cancellation

1. In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 72 hours pursuant to Article 57 of Legislative Decree 206/2005, starting from the date of receipt of the products (the courier's receipt shall be deemed to be the date of receipt).

2. In the case of multiple purchases made by the purchaser in a single order and delivered separately, the 72-hour period runs from the date of receipt of the last product.

3. Users wishing to exercise their right to cancel their purchase may do so by accessing the section: "Information - Shipping and Returns" on the LesFolies website by creating a file.

4. The purchaser shall also exercise the right of withdrawal by sending any express declaration containing the decision to withdraw from the contract or alternatively by sending the standard withdrawal form, as set out in Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.

5. The goods may be returned to our point of sale, as well as sent to:

6. The goods must be returned undamaged, in their original packaging, complete in all their parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum period of 30 days any shipping costs incurred by the user.

7. The costs incurred in returning the goods will be borne by the user.

8. In accordance with art. 56 subparagraph 3 D.Lgs 206/2005, modified by D.Lgs 21/2014, the website can suspend the refund until the reception of the product or the proof that the buyer has shipped the item or items back.

9. The right to withdrawn will not be applicable in the case in which the service or goods provided by LesFolies are included in the categories of art.59 D.Lgs 206/2005.

10. LesFolies will make the refund to the same means of payment used for the purchase. In the event of the payment made by wire transfer the user shall comunicate the following informations: IBAN, SWIFT and BIC needed for the refund.

Art. 10 - Processing of personal data

1. The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to Article 13 EU Regulation 2016/679 (Privacy Policy).

Art. 11 - Safeguard clause

1. In the event that one of the clauses of these General Terms and Conditions of Sale is null and void for any reason whatsoever, this shall in no way affect the validity of the compliance with the other provisions appearing in these General Terms and Conditions of Sale.

Art. 13 - Applicable law and competent court

1. These General Terms and Conditions of Sale are governed by and interpreted in accordance with the Italian law, without prejudice to any different overriding mandatory rules of the purchaser's country of habitual residence. Accordingly, the interpretation, performance and termination of the General Conditions of Sale shall be subject exclusively to Italian law.

2. Any disputes inherent and/or consequent to the same shall be resolved exclusively by the Italian jurisdictional authority. In particular, if the user has the status of Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same according to the applicable law.
